Even as your doctor may prescribe medical marijuana for your health condition, is it still safe to work while using it? Some jobs are safety sensitive, such as operating heavy equipment or driving commercial vehicles. Under Federal law marijuana is still considered a Schedule I drug. There is a fine line between using the medicine and being “under the influence” of it. Employers are still allowed to test for drugs and the Drug-Free Workplace Act provides them with rights under Federal law. An employee does have the right to medical privacy however many employers prefer a zero-tolerance approach. State law allows patients to use it as medicine which creates a big “loop-hole” in the system. The safest thing to do as a patient is to respect your co-workers and company policies.
